How to file a copyright infringement notice

If you believe your copyrighted work has been used on our platform without authorization, you may submit a DMCA takedown notice. We process these requests promptly in accordance with the Digital Millennium Copyright Act.

Required information for DMCA notices

  1. Your physical/electronic signature and contact information (name, address, phone, email)
  2. Identification of the copyrighted work claimed to be infringed
  3. Identification of the infringing material (specific URL where the material appears)
  4. A statement that you have a good-faith belief that the use is not authorized by the copyright owner
  5. A statement that the information is accurate and, under penalty of perjury, that you are authorized to act on behalf of the copyright owner

DMCA Compliance Process

How we handle copyright complaints

KOMI follows this process when responding to DMCA takedown notices:

Notice Review

We review DMCA notices to ensure they're complete and valid.

Content Removal

We expeditiously remove or disable access to the allegedly infringing material.

User Notification

We notify the content provider about the takedown and provide them with a copy of the notice.

Counter-Notice Option

Content providers may submit a counter-notice if they believe the material was removed in error.

Resolution

We either maintain the removal or restore content based on the legal merits of the case.

In cases of repeat infringement, KOMI reserves the right to terminate user accounts and access to our services in accordance with our repeat infringer policy.

Fair Use Policy

U.S. Copyright Law Fair Use Doctrine

KOMI respects the Fair Use Doctrine as established in U.S. Copyright Law (17 U.S.C. § 107). This doctrine permits limited use of copyrighted material without permission for purposes such as criticism, comment, news reporting, teaching, scholarship, or research.

However, not all uses for these purposes automatically qualify as fair use, and unauthorized use of copyrighted material may still constitute infringement in certain circumstances.

Four Factors of Fair Use

  • The purpose and character of the use (including whether it's commercial or nonprofit/educational)
  • The nature of the copyrighted work (creative works receive more protection than factual works)
  • The amount and substantiality of the portion used in relation to the work as a whole
  • The effect of the use upon the potential market for or value of the copyrighted work

Fair use determinations are made on a case-by-case basis. The ultimate determination of whether a particular use qualifies as fair use is made by federal courts.
